Terms and Conditions These Terms and Conditions of Sales applies to products and
services purchased directly from VICTOR VICTOR INC. Standard Terms and
Conditions of Sale: Sales of products and services purchased through VICTOR
VICTOR INC. are subject to the terms and conditions set forth below. Any
different or additional terms set by the Customer, whether in a Customer's
Purchase Order or in any other communication, are expressly objected to or
rejected and will not be binding onto VICTOR VICTOR INC. unless agreed by an
authorized officer of VICTOR VICTOR INC. Sales and Payment Terms: VICTOR VICTOR
INC's standard payment terms are Prepaid. Net terms are available with approval
from our Finance Department. Please feel free to contact your Finance Specialist
about our credit application. Other payment methods accepted by VICTOR VICTOR
INC. include: Bank Wire Transfer, Cashier Check, or Letter of Credit. If a
delinquent account is sent to Collections, the Customer will be responsible for
all collection and attorney fees.
All payments are to be made in US Dollars. If a Customer's account becomes Past
Due, VICTOR VICTOR INC. has the right to not process orders and may refuse
shipments until the account is paid in full. All orders are subject to VICTOR
VICTOR INC's minimum order policy amount of $125.00. Any orders for less than
this amount may be declined. Prices and Sales Taxes: All prices are stated in US
Dollars. Prices listed on this Acknowledgement does not include freight,
handling fees, taxes, clear custom and/or duties, and are subject to correction
or change. Any tax or other governmental charge(s) incurred upon the production,
sale, shipment, transfer, consumption, or use of the product(s) that VICTOR
VICTOR INC. is required to pay or collect from Customer shall be billed and paid
by Customer to VICTOR VICTOR INC. at time of payment for the product(s), unless
the Customer provides VICTOR VICTOR INC. with an exemption certificate(s)
acceptable to Taxing Authorities. Delivery, Title and Risk of Loss: Delivery and
shipment dates indicated on orders are estimates only and are not guaranteed.
VICTOR VICTOR INC. shall not be liable to Customer for failure to deliver on any
particular date or dates. Such dates are subject to change due to, among other
things, delay in product availability and circumstances beyond VICTOR VICTOR
INC's reasonable control. VICTOR VICTOR INC. will in good faith endeavor to ship
product(s) or perform service(s) by the estimated date. All shipment will be EXW
shipping point. Delivery of product(s) to a carrier from our shipping point
constitutes delivery to Customer where title and all risk of loss or damage in
transit shall pass to Customer at that time. All claims for loss and damage must
be made by Customer to the Carrier. When the invoiced order has a greater value
than $3,000.00, product(s) are delivered at no additional cost, when delivery is
located within the Kendall area in Miami, FL. If you have any questions about
our delivery radius, please feel free to contact your CSR. In the case where the
invoiced order is less than $3,000.00, product(s) can be delivered within the
Kendall area in Miami, FL for a minimum fee of $35.00. Order Cancellations: All
cancellations are subject to a written approval by the Manufacturer. If product
is being sent back for credit or for canceled order(s), Customer will have to
pay the freight for shipping the product(s) back to the Manufacturer and for any
re-stocking fees where applicable. Customer will be charged accordingly. For
those specific product(s) that are manufactured as a Special Order(s),
cancellations will not be permitted.
Return and Warranty Policy: Our Return Policy states that all sales are final.
Before you can return any product to VICTOR VICTOR INC., you must obtain a
Return Material Authorization (RMA). This policy applies to all warranty
repairs/replacements, non-warranty repairs and advance replacements. To obtain a
RMA, please contact your CSR for further instructions. The RMA Department will
send Customer a Return Merchandise Authorization (RMA) Form. Once the RMA Form
is received by VICTOR VICTOR INC's RMA Department, a RMA Number will be issued
and assigned to Customer along with the instruction(s) on how to return the
product(s) back to our RMA Department. Once you have the RMA number, re-package
the product(s) as per the instructions included and write the RMA Number outside
your package and also as a Reference on the Courier's Air Way Bill. All
product(s) must be returned as Prepaid Freight within 30 days of obtaining the
RMA. We reserve the right to cancel the RMA after 30 days. Mail the product(s)
to the location specified by our RMA Department within the 30 days allowed. If
you fail to return the product within the 30 days, please contact VICTOR VICTOR
INC's RMA Department to receive a New RMA. We will not accept unauthorized
returns or freight collection returns. Please keep in mind that these types of
returns will be at your own expense. If a returned product(s) contains parts
that are no longer available or repairable, we will contact you to discuss a
resolution for the return of the product(s). Credit will be issued and
Restocking Fee(s) charged upon receipt of the returned product(s) with the
acceptance from each Manufacturer involved.
